In a given case scenario, an employee files a claim of discrimination against their
employer. In the claim filed with the state Human Rights Commission and Equal Employment
Opportunity Office (EEOC), the employee cites age as a motivating factor along with several
other forms of discrimination, harassment and retaliation for filing. Governmental efforts to
counter age discrimination in the United States predate the 1967 Age Discrimination in
Employment Act (ADEA) (Neumark, 2003). During the EEOC claim handling process, the
employee filed a formal complaint in which summarized descriptions of the events they believed
to be discriminatory are explained. In the brief summary provided, the employee allegations of
discrimination are madeagainst the companies organizational hiring and selection practices based
on age. The employee includes statements that highly selecting and recruiting applicants gear the
companies hiring practices towards younger generation workers from colleges upon graduation.
Particular events described by the employee include dates and times of conversation with
colleagues, incidents with management and senior leaders over performance issues, and the
failure of human resources to investigate a claim through formal processes provided incompany
policy handbooks.
Plaintiff’s Claim
The demographics of the employee in this evaluation are female, African American race,
age over forty, and an employee who has disclosed a disability. The background of the
